Terms and Conditions of Platinum Guild India Pvt. Ltd. (PGI) ‘Voice of Gratitude’ Contest

• The ‘Voice of Gratitude’ contest is only open to residents of India (hereinafter referred to as ‘the Participant(s)’).
• There is no entry fee and no purchase necessary to enter this contest.
• By entering this contest, a Participant is indicating his/her agreement to be bound by these terms and conditions.
• How to participate: Participants are required to provide a gratitude message dedicated to their partner/spouse in the comments section of Platinum Days of Love social media posts / DMs to their handle on Facebook and Instagram. The period of the contest shall be declared by PGI on its social media handles.
• Examples: Kindly refer to the PGI posts on [Instagram and Facebook] dated 9th December 2021 wherein certain examples of the gratitude messages have been uploaded for reference.
• Selected Participants shall have their gratitude messages converted into melodies, and such melodies shall be published on PGI’s social media handles with the selected Participant and their partner/spouse tagged.
• Participant hereby represents that he/she shall only provide a gratitude message for his partner/spouse, and he/she acknowledges that on the basis of such representation, PGI considers his/her entry into the contest. PGI will not be liable for any alleged or actual harassment that may arise between any Participant and the person tagged by them.
• Participant hereby represents that his/her gratitude message shall not infringe upon any third party’s intellectual property rights, and Participant shall indemnify and hold harmless PGI against any alleged or actual infringement of third party intellectual property rights as a result of his/her gratitude message, including but not limited to copyright infringement.
• Selection of Participants is at the sole discretion of PGI and any disputes in relation to the same will not be entertained by PGI.
• Only one entry will be accepted per person. Multiple entries from the same person will be disqualified.
• Participant accepts and acknowledges that there may be variations to the gratitude message provided in order to convert the same into a melody.
• PGI shall not be responsible or liable for any dissatisfaction of Participant or their partner/spouse towards the melodies created or any variations to the gratitude message.
• PGI shall not be responsible for any incorrectly tagged Participants or their partners/spouses on its social media handles.
• PGI will not be liable for any direct or indirect losses, damages or injuries that may arise due to participation in this contest.
• Participants agree to the use and display of their gratitude messages on various social media handles of PGI (and/or its affiliates) including but not limited to Facebook, Twitter and Instagram, as well as the company website, without any compensation to such Participants or their partners/spouses in perpetuity.
• Additionally, Participants agree to the display/reference of their gratitude messages through PGI advertisements, without any compensation to the Participants or their partners/spouses in perpetuity.
• PGI reserves the right to suspend, shorten, modify, extend or cancel the contest or any of the terms and conditions of this contest, at its sole discretion at any time.
• PGI reserves the perpetual right to remove, refuse, modify or cancel any posted entry/ message or any access to any Participants, without providing any reason for such action whatsoever.
• PGI shall have the perpetual right to exploit, reuse, repost or repurpose the entries in any manner, as it may require from time to time.
• Contest is subject to force majeure events and situations beyond the control of PGI and/or its affiliates
• Employees of PGI as well as their family members are not eligible to participate in this contest.
• Participation in the said contest is purely voluntary and at the sole discretion of the person/individual participating in the contest. Participant agrees that he/she has read and understood and is bound by the terms and conditions set out herein. By participating in the contest, Participant agrees and accepts that his/her partner/spouse shall not have any problems or issues with being tagged on social media.
• The terms of this contest shall be construed in accordance with the laws of India and the courts of Mumbai have sole and exclusive jurisdiction in relation to any dispute arising in relation to this contest.
